Yesterday, the American Legislative Exchange Council (ALEC) released their study “Overregulation Threatens Market-Driven Solutions in Dentistry,” highlighting the concerns around the anti-competitive, anti-consumer nature of over-regulation in the healthcare industry. The Association of Dental Support Organizations issued the following statement:

“The latest study conducted by ALEC demonstrates the importance of a regulatory climate where healthcare providers are encouraged to adopt market-based solutions that meet ever-growing and changing consumer demand. The Dental Support Organization (DSO) model is one example of innovation that is making a difference.  DSO’s help dentists bring down costs for consumers, while enabling them to increase access and focus on patient care. It is imperative that we recognize the importance of innovation and support legislation that encourages market-based solutions that help meet the needs of providers and their patients.”

Statement by the ADSO in Response to a Recent Ruling by a Texas U.S. District Judge in Favor of the American Academy of Implant Dentistry Over the Texas State Board of Dental Examiners

We are encouraged by the recent ruling that found certain regulations of the Texas State Board of Dental Examiners infringed on the American Academy of Implant Dentistry’s First Amendment rights.

It is imperative that the regulatory activity of dental boards does not unintentionally preclude a vibrant, competitive marketplace for administrative services.  As a precautionary tale, consider proposed legislation in North Carolina in 2012.  It would have prohibited dentists from contracting with Dental Support Organizations for support in non-clinical aspects of their practices like billing, booking and purchasing equipment. The Federal Trade Commission (FTC) and the U.S. Supreme Court found that the North Carolina legislation would have reduced access to care and was anticompetitive.

Protectionist policies do not survive.  The FTC, the U.S. Supreme Court and now a District Court in Texas align with consumers and for a marketplace that rewards innovation, lowers barriers to entry and increases access for patients.  We are confident that patients, dentists and lawmakers alike understand what is at stake and will continue to promote quality options for dental practitioners.
